Margo is in controlled development. It is being built to show each finding beside its source clause, checked against your firm's own positions, for a lawyer at your firm to confirm, correct or reject.
11. Limitation of liability
11.1 Neither party excludes liability for fraud or any liability that cannot lawfully be excluded.
11.2 The Supplier's total liability shall not exceed the fees paid in the previous three months.
11.3 All indirect and consequential loss is excluded.
11.4 Clause 11.2 does not apply to the Supplier's liability for breach of clause 14 (Data protection) or clause 15 (Confidentiality).
Deviation check
The cap is three months of fees. Your approved position is 12 months.
No other deviations in clause 11.
